Terms of Service

1. About Afterly

These Terms of Service ("Terms") govern your use of the Afterly platform (afterly.au), operated by QoS Partners Pty Ltd (ABN 68 662 956 818) trading as Afterly ("Afterly", "we", "us", "our").

By creating an account or using Afterly, you agree to these Terms. If you do not agree, do not use the platform.

These Terms are governed by the laws of the Northern Territory, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of the Northern Territory.

2. What Afterly Provides

Afterly is an administrative platform for deceased estate management. We help executors and administrators of deceased estates prepare, organise and manage the documentation and processes required to administer an estate, including applications to courts and other authorities.

Afterly provides administrative assistance only. We do not provide legal advice. Nothing on this platform constitutes legal advice, and no solicitor-client relationship is formed by your use of Afterly.

You should seek independent legal advice if you are uncertain about your obligations as an executor or administrator, the validity of the Will, or any aspect of the estate administration process.

Afterly makes no warranty that documents or applications prepared through the platform will be accepted by any court, authority or third party. Acceptance depends on the accuracy and completeness of information you provide, and on factors outside our control.

3. Eligibility

To use Afterly you must:

  • Be 18 years of age or older
  • Have authority to act on behalf of the estate you are administering
  • Provide accurate and complete information throughout the process

The scope of services available through Afterly may vary depending on the jurisdiction and nature of the estate. Details of currently supported services are described on the platform at the time of use.

4. Your Responsibilities

You are solely responsible for the accuracy, completeness and truthfulness of all information you submit through Afterly. Documents are generated based entirely on the information you provide. Afterly does not independently verify the information you enter.

By using Afterly you confirm that:

  • All information you provide is true, accurate and complete to the best of your knowledge
  • You have the authority to act as executor or administrator of the estate
  • You will review all generated documents carefully before signing or lodging them
  • You understand that signing a false statutory declaration or affidavit is a criminal offence
  • You will seek independent verification of any aspect of the process you are uncertain about

5. Pricing and Payment

The fee for each Afterly service is displayed on the platform at the time of purchase and is inclusive of GST. Payment is processed securely by Stripe. Afterly does not store your card details. All fees are in Australian dollars.

6. Refunds

Refund requests are considered on a case-by-case basis at Afterly's discretion. To request a refund, contact us at hello@afterly.au with your estate reference and the reason for your request.

We will respond to all refund requests within 5 business days. Where a refund is approved, it will be processed to the original payment method within 10 business days.

7. Intellectual Property

All content, software, design and functionality on the Afterly platform is owned by or licensed to QoS Partners Pty Ltd. You may not copy, reproduce, modify or distribute any part of the platform without our written consent.

Documents generated through the platform using your estate data are yours to use for the purposes of administering the estate.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Afterly is not liable for any loss or damage arising from your use of the platform or reliance on documents generated through it
  • Afterly is not liable for rejection of documents or applications, delays in proceedings, or errors arising from inaccurate information you provide
  • Our total liability to you in connection with the service is limited to the amount you paid for the service

Nothing in these Terms excludes rights you may have under the Australian Consumer Law that cannot be excluded by agreement.

9. Privacy

Your use of Afterly is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

We may suspend or terminate your access to Afterly if you breach these Terms, provide false information, or use the platform for any unlawful purpose. You may discontinue use of the platform at any time.

11. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will notify you by email. Continued use of the platform after notification constitutes acceptance of the updated Terms.
